These Terms govern your use of caloffers.com (the "Platform"), operated by CalOffers ("we", "us"). By creating an account or purchasing a lead you agree to them. If you do not agree, do not use the Platform.

1. What we sell

We sell leads: contact and property information for homeowners who have expressed interest in selling. A lead is information, not a transaction. We do not promise that any lead will answer the phone, agree to a price, or close a deal, and we are not your agent, broker or partner in any transaction you pursue.

We are not a licensed real estate brokerage and we do not provide real estate, legal, tax or investment advice.

2. Eligibility and accounts

• You must be 18 or older and using the Platform for business purposes.
• You are responsible for everything done through your account, and for keeping your password and two-factor codes secure.
• One account per business unless we agree otherwise. Sharing account access with non-employees is prohibited.

3. Exclusive and shared leads

Each listing states whether it is exclusive (sold once) or shared (sold to a limited number of buyers, shown on the listing). Shared leads may be purchased by competing investors.

4. Payment, balance and refunds

• Prices are shown in US dollars. You may pay by card at checkout or from your account balance.
• Balance top-ups are prepayments for future lead purchases. Balance has no cash value, does not expire unless required by law, and is not refundable to your card except as required by law or under the guarantee below.
• Card payments are processed by Stripe; we never receive your full card details.
• Because a lead's value is delivered instantly and irreversibly upon disclosure of the seller's contact details, all sales are final except under the guarantee in section 5.
• Chargebacks filed without first contacting support may result in account suspension.

5. Lead quality guarantee

We credit your balance for a lead if, within 60 days of purchase, you show us that:

• the phone number was disconnected or does not belong to the person listed; or
• the person never inquired about selling a property; or
• the property or seller details were materially misstated in the listing.

Credits are issued to your Platform balance, not to your card. The guarantee does not cover leads who simply do not answer, change their mind, decline your offer, or sell to someone else. We may require your call logs or CRM records. Abuse of the guarantee is grounds for suspension.

6. How you may use leads — your legal obligations

By purchasing a lead you agree that you will:

• comply with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, California's calling and recording laws (including two-party consent for call recording), CAN-SPAM and all other applicable laws;
• honor any do-not-call, do-not-text, deletion or opt-out request a consumer makes to you, and pass such requests to us at privacy@caloffers.com;
• maintain your own internal do-not-call list;
• not use automated dialing, prerecorded messages or SMS in a manner that requires consent you do not have;
• not misrepresent yourself as CalOffers or as the seller's agent.

You also agree that you will not:

• resell, redistribute, syndicate, or publish leads, or add them to any shared or third-party database;
• scrape, bulk-download or reverse-engineer the Platform, or use bots against it;
• use leads for any purpose other than your own real estate acquisition business.

You indemnify us against claims, fines and legal costs arising from your contact with leads or your breach of this section.

7. Suspension and termination

We may suspend or close an account that breaches these Terms, abuses the guarantee, files fraudulent chargebacks, or exposes us to legal risk. Remaining balance may be refunded at our discretion, less amounts owed, unless the account was closed for fraud.

8. Disclaimers and limitation of liability

The Platform and the leads are provided "as is", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy of seller-supplied information. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us for the specific lead giving rise to the claim, and we are not liable for lost profits or indirect, incidental or consequential damages.

9. Changes

We may update these Terms; the "last updated" date reflects the current version. Material changes will be announced on the Platform, and continued use after that constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in California.
